Twitter class action alleges company uses personal information for marketing purposes

Summary of the Twitter Personal Information Marketing Class Action Lawsuit:

Twitter fails to tell its users that it uses their phone numbers and email addresses for marketing and advertising purposes, a new class action lawsuit alleges.

A group of Twitter users led by Peter Gianakopoulos alleges that the social networking company “requested and collected” their phone numbers and email addresses “under the guise” that they were needed for account security functions.

Twitter users argue that the company actually used the information to “line its own pockets” by matching phone numbers and email addresses obtained with those on advertiser-owned lists.

“This case seeks vindication and redress on behalf of the individual consumers whose personal data Twitter lovingly collected and shared,” the Twitter class action says.

The Twitter class action alleges that users believed their contact information would only be used for account security

The belief among Twitter users was that their phone numbers and/or email addresses would be used to enable two-factor authentication, account re-authentication and account recovery, according to the Twitter class action.

The plaintiffs allege the company is guilty of unjust enrichment, breach of contract and breach of implied contract and in violation of California law. Law on Unfair Competition.

They request a jury trial and seek declaratory and injunctive relief along with statutory and nominal damages for themselves and all class members.

Twitter users want to represent a nationwide class of Twitter account holders who have provided the company with their phone number and/or email address on the assumption that it will be used for account security purposes.

In related Twitter news, last month Twitter revealed that a data breach was affecting its platform exposed personal contact information of its more than 5.4 million users.
